As a Vermont Personal Injury Lawyer, I have represented clients in a variety of serious accident claims, from slips and falls and automobile accidents to construction accidents and animal attacks. When you or a family member has been in a serious accident in Vermont, you could face mounting medical costs, loss of income and emotional or physical pain and suffering. With my focus and determination as an experienced lawyer, I can help you navigate your way through the complicated process, negotiating with insurance companies or litigating your case in court
I have been litigating in Vermont courtrooms since 1982, the year I was admitted to practice as a lawyer. I have successfully tried cases in state and federal courts, and have won reversals of adverse jury verdicts in state and federal appellate courts as well. I also serve as mediator, selected by parties involved in civil litigation, to oversee settlement negotiations. I have been an instructor at continuing legal education programs for lawyers learning DWI Defense Techniques and proper handling of Personal Injury cases. From 2003 to 2009 I served as one of three Vermont Bar Association member elected representatives to the Judicial Nominating Board, which screens and recommends judicial candidates.
I have been listed since 2008 with “The Best Lawyers In America” and I have also been listed in “New England Super Lawyers” in 2009 and 2010. Listing with “The Best Lawyers In America” and “Super Lawyers of New England” is by selection only, and is based upon peer recognition, professional achievement and peer evaluation.
My professional affiliations include both state and national plaintiff personal injury and criminal defense organizations, and the National College for DUI Defense. Since 1983 I have represented clients without charge, for Vermont Legal Aid and ACLU – Vermont. I am a graduate of Syracuse University (1977) and New England School of Law / Boston (1981).
Focus
Success in the courtroom requires the ability to concentrate not only on the needs of each client, but also on the proper development of the factual and legal issues of that client’s case.
To accomplish these goals, I work with a wide variety of highly trained specialists. Depending upon the case, a nurse might analyze and abstract a client’s medical records and do medical research, while medical, vocational and economic expert witnesses would calculate the physical and economic losses suffered, in personal injury and workers compensation cases, for presentation at trial. An accident reconstruction expert might be called in to determine fault in a complex auto collision, while a medical illustration firm may be hired to graphically depict injuries and resulting surgeries for courtroom use. Also, in DUI cases, a forensic chemist is often retained to challenge the state’s evidence of blood alcohol levels, including attacking the infrared machine used to analyze the client’s alcohol content.
Focus also means being able to devote the time necessary to each client’s case. To that end, I limit the number of clients I represent in order to provide the best possible service. Clients are regularly copied with correspondence, emails, and pleadings. All telephone calls are returned within 24 hours, normally on the same day received. I believe that actively involving the client in their case, honesty and openness are all key to a successful lawyer – client relationship. While we lawyers like to talk, I firmly believe it’s just as important that I listen to my clients – because communication is a two-way street!
Results
Proof positive of the results I achieve for my clients is my inclusion in both The Best Lawyers in America and New England Super Lawyers (for Criminal Defense). Listing with these publications is by invitation only and is based upon rigorous screening which includes multi-level peer review.
My personal injury verdicts and settlements include a $590,000.00 settlement for a car crash, $250,000.00 arbitration award for a supermarket fall-down, and a jury verdict of $138,000.00 for a wintertime slip and fall, where the client’s treatment costs were less than $2,000.00.
While few matters are actually decided by a jury, each client’s case is prepared from the start with the expectation that it will be tried. A successful result can follow from negotiations either before the filing of a criminal charge or civil lawsuit, or settlement prior to trial, or when the jury renders its verdict. Each client’s tolerance for risk, range of possible outcomes, and case strengths and weakness are carefully weighed in advising the client the best possible course of action.
